[Humans of Planet Earth Foundation] is a [Delaware nonstock corporation] in the process of applying for exemption from federal income tax under Section 501(c)(3) of the Internal Revenue Code. While an application is pending before the IRS, [Humans of Planet Earth Foundation] is permitted to treat itself as exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code. If [Humans of Planet Earth Foundation] ultimately qualifies for exemption under the Internal Revenue Code, then charitable contributions made by a donor to [Humans of Planet Earth Foundation] during this period are generally eligible, to the extent permitted under applicable law, to be treated as charitable contributions deductible to the donor. However,
there is no assurance that [Humans of Planet Earth Foundation] will qualify as an organization exempt from tax under Section 501(c)(3) of the Internal Revenue Code and, if [Humans of Planet Earth Foundation] does not qualify for exemption from federal income tax under the Internal Revenue Code, then any contributions made by a donor to [Humans of Planet Earth Foundation] during this period would not be eligible to be treated as charitable contributions deductible to the donor.
